SR Dream IT Legal Terms Notice
This notice outlines the legal terms governing the use of SR Dream IT's company name, trademark, logo, SR Dream IT content on social media platforms and copyrighted materials. Unauthorized use of these assets is strictly prohibited.
1. Company Name, Trademark, and Logo
SR Dream IT's company name, trademark, and logo are legally protected. No individual or entity may use these assets without the express written permission of SR Dream IT. This includes, but is not limited to, using the name, trademark, or logo in any advertising, marketing materials, publications, websites, or social media.
Legal Basis: The protection of company names, trademarks, and logos is derived from trademark law, which varies by jurisdiction. In many countries, including Bangladesh, trademark rights are acquired through registration with the relevant intellectual property office. Unregistered marks may also be protected under common law principles against unfair competition. Using another's trademark without permission can constitute trademark infringement, unfair competition, or other legal violations.
Actions for Unauthorized Use: SR Dream IT will vigorously pursue all available legal remedies against any unauthorized use of its company name, trademark, or logo. These remedies may include:
Cease and Desist Letter: A formal letter demanding the immediate cessation of the unauthorized use.
Legal Action: Filing a lawsuit for trademark infringement, unfair competition, or other related claims. This may seek injunctive relief (a court order stopping the infringing activity), monetary damages (compensation for losses), and attorney's fees.
Criminal Charges: In some jurisdictions, particularly in cases of willful or intentional infringement, criminal charges may be pursued.
2. Copyright
All content created and owned by SR Dream IT, including but not limited to posters, videos, written content, website materials, social media content (including YouTube, Facebook pages and groups, Instagram), course access, course-related videos, and course resources, is protected by copyright law. No individual or entity may reproduce, distribute, modify, or display any copyrighted material without the express written permission of SR Dream IT.
Legal Basis: Copyright law protects original works of authorship, including literary, artistic, musical, and certain other intellectual works. Copyright protection arises automatically upon creation of the work. Copyright infringement occurs when someone reproduces, distributes, performs, displays, or creates derivative works based on a copyrighted work without the copyright owner's permission.
Actions for Copyright Infringement: SR Dream IT will take all necessary legal action to protect its copyrighted materials. These actions may include:
Digital Millennium Copyright Act (DMCA) Takedown Notices (where applicable): Sending notices to online service providers to remove infringing content.
Cease and Desist Letter: A formal letter demanding the immediate cessation of the infringing activity.
Legal Action: Filing a lawsuit for copyright infringement. This may seek injunctive relief, monetary damages (including actual damages and lost profits, or statutory damages), and attorney's fees.
3. Social Media, Course Materials, and Online Platforms
Specifically, all SR Dream IT content on social media platforms (YouTube, Facebook pages and groups, Instagram, TikTok, LinkedIn), websites, course access portals, course-related videos, and course resources are protected by copyright law. 4. Specific Reference to Bangladesh Laws
While the general principles above apply internationally, it's important to consult with a legal professional in Bangladesh for specific details regarding Bangladeshi intellectual property laws. Reference to specific acts and sections would require legal counsel familiar with the current laws of Bangladesh. For example, the Copyright Act, 2000 of Bangladesh, as amended, governs copyright protection.
In September 2023, the Parliament of Bangladesh enacted the Copyright Act, 2023, replacing the previous Copyright Act of 2000.
It is important to understand the intellectual property laws specific to Bangladesh. The Copyright Act, 2023 of Bangladesh, governs copyright protection within the country.
Enhanced Penalties for Infringement:
The Act imposes stricter penalties to combat piracy and unauthorized use:
Unauthorized Publication or Performance: Fines up to 500,000 BDT.
Infringement of Film Rights: Fines up to 1,000,000 BDT and imprisonment for up to 5 years.
